Terms and Conditions (T&C) of Fr4meX
1. Scope
(1) These Terms and Conditions (T&C) apply to all contracts concluded between Fr4meX (hereinafter referred to as the "Provider") and customers via the online store www.fr4mex.com.
(2) The Provider sells high-quality metal posters, wall decorations, and merchandise products and ships them worldwide.
(3) Small Business Regulation:
- The Provider operates as a small business under § 19 UStG (German VAT law) and therefore does not display VAT in invoices.
(4) Any deviating or conflicting terms and conditions of the customer are not recognized unless explicitly agreed upon in writing by the Provider.
2. Contract Conclusion
(1) The products displayed in the online store do not constitute a legally binding offer, but an invitation to place an order.
(2) By submitting an order, the customer makes a binding offer to purchase the selected product. The contract is only concluded upon explicit confirmation by the Provider or upon the shipment of the goods.
3. Prices & Payment
(1) All stated prices are final prices without VAT (in accordance with § 19 UStG).
(2) The customer can choose from various payment methods, including PayPal, credit card, Klarna, Sofortüberweisung, and other payment options specified in the online store.
(3) The goods remain the property of the Provider until full payment has been received.
4. Delivery & Shipping
(1) Worldwide shipping: The Provider ships orders globally.
(2) Shipping costs are displayed during the checkout process and are to be paid by the customer.
(3) If delivery is not possible due to reasons beyond the Provider's control (e.g., force majeure, strikes, supply shortages from third parties), the customer will be informed immediately. In such a case, the customer can withdraw from the contract or accept a later delivery date.
5. Right of Withdrawal & Returns
(1) Many products offered by Fr4meX are made individually and are therefore legally considered personalized goods under Section 312g (2) No. 1 BGB. We provide a service for producing the motifs shown in our shop according to customer specifications.
For this reason, there is no statutory right of withdrawal* for these products, and returns, cancellations, or refunds are excluded.
(2) In the case of damage during shipping or quality issues, no return is necessary – we will provide a free replacement.
*A return is only possible if the delivered product significantly and demonstrably deviates from the description (e.g., wrong motif, wrong size, incorrect personalization).
(3) If a package is returned to us for any reason (e.g., failure to collect, incorrect address, failed delivery), reshipping will incur additional shipping costs. These costs correspond to the original shipping charges.
If the original delivery was offered free of shipping costs, the flat rate for reshipping is €4.99.

6. Copyright, Licenses & Disclaimer
(1) Original Design Interpretations:
- All Fr4meX designs are original creative interpretations and not direct copies of existing works, brands, or franchises.
- If designs are inspired by known styles, they are transformed and unique, ensuring they are not mistaken for official products.
(2) License & Copyright Statement:
- The Provider guarantees that all designs offered on the website are either original creations, licensed works, or freely usable designs.
- If a third party claims a copyright infringement, the Provider will review the matter and, if necessary, remove the affected design.
- The Provider is not liable for violations caused by false information from third parties or by the customer’s use of the designs.
(3) Customer Uploads & Custom Designs:
- If a customer uploads their own design, they confirm that they own full rights and licenses for its use.
- The customer indemnifies the Provider against any third-party claims resulting from potential copyright violations.
(4) Liability Disclaimer for Designs Similar to Protected Works:
- All designs by Fr4meX are artistic interpretations and are not directly associated with existing franchises or brands.
- Any similarity to existing works is purely coincidental and does not imply official licensing.
- The Provider does not guarantee that a design does not accidentally resemble protected works that are not clearly identifiable as requiring licensing.
- If a design falls under parody or transformative use, the customer is responsible for assessing potential risks.
(5) Sales to End Customers Only:
- The Provider sells its products exclusively to end customers.
- Resale or commercial use of the designs is prohibited unless explicitly permitted by the Provider.
7. Liability & Warranty
(1) The Provider is only liable for willful misconduct or gross negligence.
(2) The Provider is not responsible for damages caused by improper use of the products (e.g., incorrect mounting, external damage).
(3) The customer must inspect the goods upon receipt and report any damages within 7 days to the Provider.
8. Data Protection
(1) The Provider processes personal data only in accordance with legal regulations.

9. Final Provisions
(1) German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes, where legally permissible, is the Provider's registered office.
(3) If any provision of these T&C is found to be invalid, the remaining provisions remain unaffected. The invalid clause will be replaced by a legally permissible provision that comes closest to the original economic purpose.
